Terms of use

1. Provider and scope

GeoFootballer (geofootballer.com) is provided by Nomad Agency for Marketing & Consulting LLC, 2880 W Oakland Park Blvd, Suite 225C, Oakland Park, FL 33311, USA, email: mustafa.ali@na4mc.de (“we”). These terms apply to your use of GeoFootballer and to the GeoFootballer Pro subscription.

2. What GeoFootballer offers

GeoFootballer is a quiz: for each football moment you drop a pin on a map and score points based on how close you are. Free of charge are the daily round, the daily timed round, your streak, daily challenges, badges, choosing your favourite club, joining a live duel while it is open and has places free, and taking part in a group: the daily and overall tables, reactions, and competitions on one of the 3 guest places per group, as long as one is free.

GeoFootballer Pro also unlocks: setting up to 10 groups of your own, being in up to 50 groups at the same time, starting competitions and playing in every competition, opening live duels (with an OBS overlay for streams), every category as often as you like, including against the clock, custom rounds, the archive of past matchdays, personal stats, the die-hard badge and backing your favourite club in the die-hard ranking. We research questions and answers carefully, but we can't rule out mistakes. We keep adding to and changing the question pool. You are not entitled to particular questions or categories, as long as the scope of Pro remains essentially the same.

Guest places are given out in the order members joined the group; when one becomes free, the next member without Pro moves up. You are not entitled to a guest place. We may raise the limits for groups and guest places in your favour.

3. Fair play

You can play without an account. Please stick to a few rules:

• No automated requests, bots or attempts to read out answers before you place your guess.
• No offensive or unlawful names for yourself or your groups.
• No reselling of access and no use of the content for your own services.

If the rules are broken, we may change names, remove entries from tables and, in serious cases, block access. In live duels we automatically filter common insults and links out of names, and whoever opened the duel can remove players and close it to new players.

4. Buying in the browser or in the app

In the browser, orders for GeoFootballer Pro are handled by our merchant Sold through Link, LLC, a company in the Stripe group (“Link”). Link is the merchant of record for these orders. The purchase contract is made with Link, and Link takes care of payment, invoicing, VAT, customer service for payments and refunds. Link's terms also apply.

In the app you buy Pro through Apple's App Store or Google Play. Apple or Google is then your contracting party for payment, billing, cancellation and refunds, and their terms apply, for Apple the Licensed Application End User License Agreement (EULA). These terms also apply to your use of GeoFootballer.

To buy, you need a GeoFootballer account, signed in with your email address, with Apple or with Google. Pro then works on every device where you're signed in, in the browser and in the app.

5. Prices, term and cancellation

GeoFootballer Pro costs 0,99 € a week or 2,49 € a month, VAT included in each case. The checkout shows the exact amount for your country before you buy.

The subscription renews automatically for the period you chose unless you cancel beforehand. You can cancel at any time, in your account at link.com, via Link's order confirmation or by emailing us; a subscription bought in the app is cancelled in your Apple Account settings or on Google Play, at least 24 hours before it ends. Cancellation takes effect at the end of the period you've paid for, and Pro stays active until then.

We will tell you about price changes at least 30 days before your next renewal. They only apply from that renewal, and you can cancel before then.

6. Right to cancel and refunds

The rules on cancellation and refunds are on the Refunds page. In short: within 14 days of any payment in the browser, you can have the full amount back on request, no reason needed. Purchases in the app follow Apple's or Google's refund rules.

7. Availability

We do our best to keep GeoFootballer available at all times. Maintenance, outages at our service providers or force majeure can cause interruptions. If Pro is unavailable for a significant period, we will refund the proportionate amount on request.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are only liable for breach of essential contractual obligations, meaning those that make using GeoFootballer possible in the first place, and only up to the amount of foreseeable damage typical for this kind of contract.

9. Changes to these terms

If we change these terms, we will email Pro customers at least 30 days in advance. For a running subscription, the changes only apply from the next renewal, and you can cancel before then.

10. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the law of the country where you habitually live.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body. If something goes wrong, just drop us an email.
